ION LLC <br />NAME OF DEVELOPMENT: STONEUAY <br />THIS AGKKKMENT, made and entered into this day of ____2003, <br />by and betAveen the City of Orono, a municipal corporation organized and existing under the <br />laws of the State of Minnesota (hereinafter called “City”), and Daldstrom Development <br />Corporation LLC, a Minnesota Corporation, its heirs, successors and assigns (hereinafter called <br />“Developer”). <br />WITNESSE aH: <br />WHEREAS, the Developer has made application to the City Council for approval of a <br />Planned Unit Development (PUD) rezoning and tormal plat application for property located at <br />“2550" Wayzata Boulevard, such dcvelopiiient to include tlie following dements: <br />1. Rezoning of the portion of the Property north of Kelley Parkway from RR-IB Single <br />Family Rural Residential District to RPUD Residential Planned Unit Development <br />District for construction of 162 residentiril multi-family dwelling units on a portion of the <br />site comprising approximately 41 acres, such development to be known as <br />“STONEDAY”. <br />2. Creation of two commercial outlots south of Kelley Parkway to be rezoned and <br />developed at a later date. <br />3. As part of the residential development, construction of Kelley Parkway as a public street, <br />as well as construction of municipal sewer, water, and storm sewer systems to serve the <br />proposed development; and <br />WHEREAS, on January 27, 2003 the City Council granted General Development Plan <br />Approval for the proposed development subject to conditions per Resolution No. 4915, on the <br />condition that the Developer enter into this agreement to provide for conlormance with the City’s <br />Planned Unit Development (PUD) ordinances, and to provide for the installation of and establish <br />responsibilities for maintenance of improvements associated with the development. <br />NOW, TIIEREFORl^, in consideration of the premises, and of the actual promises and <br />conditions hereinafter contained, it is hereby agreed as follows: <br />A.
