oT o <br />1^ <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO.4 i <br />5. <br />and recommended approval by a vote of 7 to 0. <br />4. The Planning Commission made the following findings of fact: <br />A. The '/a acre lot is small compared to the LR-IA zoning district 2-acre <br />standard. <br />B. Hardcover in the 500-1000' zone will increase to 13.3%, remaining below ihe <br />allowed 35%. <br />C.Structural coverage on the property will increase to 9.9%, remaining below <br />the allowed 15%. <br />D. The residence was built prior to cuiTCnt zoning standards. <br />n.The neighboring residence adjacent to the proposed setback encroacluncnts <br />arc sufficiently distant so as to be not negatively impacted by the <br />encroachment. <br />The City Council finds that the conditions c.xisting on this properly are peculiar to <br />it and do not apply generally to other property in this zoning district; that granting <br />the variance will not adversely affect traffic conditions, light, air nor pose a fire <br />hazard or other danger to neighboring property; would not merely serve as a <br />convenience to the applicants, but is necessary to alleviate a demonstrable hardship <br />or dilTiculty; is necessary to preserve a substantial property right of the applicants; <br />and would be in keeping with the spirit and intent of the Zoning Code and <br />Comprehensive P!;’.:: of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City Staff, comments by <br />the applicants and the effect of the proposed variance on the health, safely and <br />welfare of the community. <br />Page 2 of 5
