#05-3071 <br />Jaimary 18,2005 <br />of 3 <br />Hardship Statement <br />Applicant has provided a brief hardship statement in Exhibit B, and should be asked for <br />additional testimony regarding the application. <br />Hardship Analysis <br />/m c0MtUeriMg applications/or variance, the Hanning Commission shall consider the effect of the <br />proposed variance upon the health, Mgfety and welfare of the community, existing and anticipated <br />traffic conditions, light and air, danger ^flre, rish to the public safety, and the effect on values of <br />property In the surrounding area. The Hanning Commission shall consider recommending approval <br />for variances from the literal provisions of the Zoning Code In Instances where their strict <br />enforcement would cause undue hardship because of circumstances nnlgue to the Individual <br />property under consideration, and shall recommend approval only when It Is demonstrated that such <br />actions will be In keeping with the spirit and Intent of the Orono Zoning Code. <br />Staff finds a hardship exists in order to grant a lot area variance. A residence has existed <br />on this lot prior to adoption of the current Zoning Ordinance, similar to many otlier <br />properties in the City. It has been the City ’s policy to approve lot area variance requests <br />whoi lots arc not more intcn.scly develops, when a home has existed in the past, and all <br />other Zoning Ordinance requirements can be met. The applicant has provided plans that <br />will not require approval of any other variances and the new residence will be placed in a <br />conforming location as oppos^ to the existing structures on the lot. The City Engineer <br />has reviewed the preliminary grading plan but final approval will be a stipulation of <br />building pennit issuance. Staff therefore finds tliat tlic applicant has demonstrated a <br />hardship and should be granted approval of a tot area variance. <br />iMuea for Consideration <br />1 . Arc there any other issues or concerns with this application? <br />Staff Recommendation <br />Approval of the lot area variance to permit construction of a new residence on an existing <br />0.835 acre lot when 2.0 acres is normally required.
