White seconded, to approve the purchase of a Public Works replacement side flail <br />mower from Diamond Mowers, Inc., at a total cost of $17,790 to be funded from the year 2004 <br />Improvement and Equipment Outlay Fund budget. VOTE: Ayes 5, Nays 0. <br />* 19. WATER SYSTEM VULNERABILITY ASSESSMENT <br />Murphy moved. White seconded, to approve the W'atcr System Vulnerability Assessment and <br />Emergency Response Plan preparation by Bonestroo Engineers at a cost of $12,900, to be funded <br />from the Water Fund, and approval of a budget adjustment to the 2004 Water Fund budget to <br />reflect this expenditure. VOTE: Ayes S, Nays 0. <br />20. BIRCH LANE CONDEMNATION - RESOLUTION NO. 5272 <br />Gappa stated he has spoken with the property owner today, with the property owner suggesting that the <br />City purchase the entire property valued at approximately $20,000. Gappa stated the value for the <br />casement is $1,600. Gappa commented the property owner was informed that the City docs not require <br />the entire property and noted the City will continue negotiations with the property owner in order to arrive <br />at some kind of solution. <br />Murphy stated in his view condemnation by the City should be a last resort and that the $1,600 is a <br />reasonable amount to pay for this easement. <br />Murphy moved. White seconded, to adopt RESOLUTION NO. 5272, a Resolution Authorizing the <br />Permanent Taking of Land by Eminent Domain for the Birch Lane Drainage Project. VOTE: <br />Ayes 5, Nays 0. <br />CITY AD.MINISTRATOR’S REPORT <br />*21. 2005 FEE SCHEDULE - ORDINANCE AND SU.M.MARY ORDINANCE FOR <br />PUBLICATION NO. 22, THIRD SERIES <br />Murphy moved. White seconded, to adopt ORDIN.ANCE NO. 22, Third Series, an Ordinance <br />Adopting the 2005 Fee Schedule and Repealing Ordinance No. 224, Second Scries, and Summary <br />Ordinance for Publication. VOTE: Ayes 5, Nays 0. <br />22. 2005 MEETING SCHEDULE <br />Murphy stated he would like to see some Council workshop dates scheduled. Murjihy suggested the <br />Tuesday after each Council meeting be set aside for a workshop, with a minimum of one workshop a <br />month. <br />Moorsc indicated Staff would prefer the Council workshops be held on rhursda) following the Council <br />meeting. <br />Murphy indicated he is agreeable to Thursdays if it is in the same week as the Council meeting, <br />PAGE 22
