CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 66 7 0 <br />RESOLUTION VACATING A PORTION OF A PERMANENT FLOWAGE AND <br />CONSERVATION EASEMENT AND RESTRICTIVE COVENANT <br />LOCATED ON 1125 PINE VIEW DRIVE, IN THE CITY OF ORONO <br />FILE #16- 3853 <br />WHEREAS, pursuam to Minnesota Statutes g 412.851 the Orono Planning Commission <br />has conducted a hearing preceded by two (2) weeks published and posted notice and mailed <br />notice to the abutting property owners, to consider the vacation of a portion of the Grant of <br />Permanent Flowage and Conservation Easement and restrictive Covenant for Wetland and <br />Wetland Buffer (the "Conservation Easement") recorded with the Hennepin County Recorder on <br />November 14, 2013, as Document No. A10028717 over property identified as 1125 Pine View <br />Drive, PID 28-118-23-42-0007; and legally described as Lot 1, Block 1, Pine View (hereinafter <br />"Subject Property"). <br />WHEREAS, the Conservation Easement exists over most of the western portion of the <br />Subject Property. The portion of the Conservation Easement described on Exhibit A and depicted <br />on Exhibit B attached hereto affecting the Subject Property is no longer needed for public purpose. <br />WHEREAS, following the hearing and consideration of the proposed vacation, the Council <br />has determined that it is in the public interest to vacate the Conservation Easement as it affects <br />the Subject Property. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orono: <br />That portion of the above-described Conservation Easement as it affects the Subject <br />Property is hereby vacated. <br />2.
