Zoning File #1623 <br />March 13, 1991 <br />Page 2 of 2 <br />Discnssion - <br />Based on the City Engineer's comments, there would appear to <br />be no detriment to neighboring properties if this fill is <br />allowed. As you can see from the original subdivision contour <br />map, this lot receives run-off from the neighboring properties to <br />the west and north. Directly east, Kim Edwards at 2450 <br />Woodhaven Drive has been allowed to fill the front half of his <br />property, via a previous conditional use permit. However, the <br />rear of the property has been maintained as a swale area for <br />neighborhood run-off to continue eastward to the pond. <br />One additional benefit of allowing the applicant to fill in <br />the proposed location is to move drainage away from Edwards' <br />mound sewage treatment system. The presence in the spring of <br />standing water in applicant's yard may have a negative impact on <br />his neighbor's mound system, hence removing the ponding area is a <br />benefit. <br />The current application was submitted without the after-the- <br />fact investigation fee, which is equal to the application fee of <br />$200.00. The City fee schedule (see Exhibit H) indicates that <br />the after-the-fact investigation fee is mandatory for after-the- <br />fact applications. Although applicant has cooperated fully with <br />City requirements since he was advised of the need for permits, <br />staff does not have the authority to waive the after-the-fact fee <br />because a zoning violation (i.e. CUP requirement) exists. Unless <br />Planning Commission feels there is justification to recommend <br />waiving the investigation fee for this application, it would be <br />due before the after-the-fact grading permit could be issued. <br />(Fee structure is as follows: land alteration CUP application <br />fee $200; after-the-fact investigation fee $200; grading permit <br />$75.00; after-the-fact permit fee $75). Total ■» $550.00. <br />Staff Recomendation - <br />Staff recommends approval of the conditional use permit for <br />filling approximately 500 cubic yards subject to the following <br />i conditions: <br />A. Applicant shall adhere to the grading plan as proposed. <br />B.
