A significant position of "t#*! <br />the immediate <br />houses in the <br />neighborhood encroach into the’35’ front setback. Directly <br />across the street, the house at 1448 Park Drive was allowed <br />to extend as close as 16' to the right-of-way in 1984. In <br />1977, an addition at 1442 Park Drive was required to be off <br />set from the existing house to meet the 35' front setback. <br />DiscQSsion - ^ j ^ ^The existing residence was constructed prior to adoption of <br />the 35' setback requirement. The location of the existing house <br />and its floor layout, along with a need for additional Indoor and <br />outdoor space, are the justifications presented by the applicant <br />for granting a variance. <br />In formulating a recommendation on this request. Planning <br />Commission should consider the following questions: <br />A. Are there special conditions or circumstances affecting <br />this property such that strict application of the provisions <br />of the ordinance would deprive the applicant of the <br />reasonable use of his land? <br />B. Is the variance necessary for preservation and enjoyment <br />of a substantial property right of the homeowner? <br />C. Will the granting of the variance be detrimental to the <br />public welfare or injurious to other property in the area? <br />D. Is the plight of the landowner due to circumstances <br />unique to this property not created by the landowner? <br />w E. Will granting of the variance alter the essential <br />character of the locality? <br />P. Is the granting of the variance necessary to alleviate <br />demonstrable hardship or difficulty, or will it merely <br />serve as a convenience to the applicant? <br />Neither hardcover nor lot coverage are an issue on this <br />property. Hardcover will be approximately 12.2% where as much as <br />30% would be allowed.
