- f <br />‘>*w,r <br />k. <br />To:Chairman Kelley and Planning Commission Members <br />Mayor Peterson and City Council <br />Ron Moorse, City Administrator <br />From Jeanne A, Mabusth, Building & Zoning Administrator <br />Date:November 14, 1991 <br />Subject: #1701 Phyllis Sprague, 3340 North Shore Drive <br />Variances - Public Hearing <br />Pertinent Ordinance -* <br />Section 10.03, Subd. 5 (E) - Whenever a lawful non- <br />conforming use of a structure or land 'is discontinued and remains <br />discontinued for a period of twelve months, any future use of <br />said structure or land shall be in conformity with the provisions <br />of this zoning chapter. <br />Permanent residential use of this property ceased sometime <br />in 1983. The structure was temporarily used for residential <br />purposes by employees of the adjacent marinas between 1983 and <br />1985. In approximately 1985, the building was completely gutted <br />and used for storage by the marinas. In addition, the remaining <br />portion of the property was used for the parking of commercial <br />vehicles and storage of boats. The commercial use of this <br />property was never approved by the City and has never been <br />legally recognized with the issuance of a zoning Certificate of <br />Occupancy. All modifications of the subject structure were done <br />without the benefit of building permits. Accessory structures <br />were removed on the property sometime within 1983-1984. <br />The applicant proposes the restoration of an accessory <br />residential use on the property.
