Mabusth, Building s Zoning Administrator <br />Date:October 17, 1991 <br />Subject:#1696 Stephen & Joanie Ward, 4695 North Shore Drive <br />Variances - Public Hearing <br />Zoning District: LR-IB, Lakeshore residential, 1 acre minimum <br />Pertinent Ordinances <br />1.Section 10.75, Subd. 3 - Additional heights on sloping lots. <br />"On any lot sloping downhill from the street, <br />which has an average ground slope on that portion <br />of a lot to be occupied by the main building of <br />25% or more (measured in the general direction of <br />the side lot lines). An additional 12' of height <br />may be permitted in such main building and the <br />garage or parking space may be in the required <br />front yard provided a yard of 10' or more is <br />maintained." <br />A. <br />B. <br />Allowed height. Based on the above Code section, the <br />principal building is located on a slope of 26-31%. An <br />increase of 12' is allowed for principal structure. <br />Total allowed = 42' <br />Proposed at lakeside = 39' <br />Height at street elevation = 20' <br />No variance required. <br />Street setback. 10' was proposed by applicant. 35' is <br />required per the LR-IB zoning district for street <br />setback of principal structure. In early discussions <br />with applicant, a garage addition was proposed at the <br />County road level. The preliminary design shewed a <br />first level floor beneath the garage with connecting <br />breezeway type addition to the main residence. In <br />those early discussions staff considered the structure <br />predominately a garage addition and qualified under the <br />above section. In a later revision a full third story <br />appeared for the master bedroom s^iite. Question for <br />the Planning Commission, "Is this a "main" building c : <br />garage addition?" <br />Per LR-IB Standards <br />Required = 35' <br />Proposed = 10' <br />Variance =21' or 71% <br />Per Section 10.75, Subdivision 3 <br />Allowed = 10' <br />Proposed = 10' (does not include enchoachment <br />of upper level deck)
