¥ <br />¥ <br />Exhibit B which is attached hereto and incorporated herein by <br />reference. 2is part of the application for rezoniny of the <br />subject property, Long Lake agrees to extend sewer and water to <br />the subject property, which shall be chargeable against Long <br />Lake's allocation for sewer and water units. <br />2.Upon filing of the application for rezoning and <br />subdivision approval with Orono, Orono agrees that it will use <br />its best efforts to expeditiously process the applications. <br />Additionally, upon receiving all appropriate filings from Long <br />Lake as an applicant property owner for subdivision, rezoning <br />and comprehensive plan amendment, Orono shall commence its <br />required procedure to file an application with the Metropolitan <br />Council to amend the MUSA line and shall work with the <br />Metropolitan Council to expeditiously process that application. <br />Orono agrees to process all aspects of the rezoning and <br />subdivision applications simultaneously with the processing of <br />the application for amendment of the MUSA line with the <br />Metropolitan Council. <br />3. This Agreement is expressly contingent upon the <br />zoning approvals of Orono, and the approval of the amendments <br />to the MUSA line by the Metropolitan Council, in a form that in <br />thft Bolft judgment of Long Lake would permit the reasonable <br />development of the thirteen (13) lots on the subject property <br />Upon the granting of the zoning approvals of Orono, and the <br />approval of the amendments to the MUSA line by the Metropolitan <br />Council Orono shall contemporaneously complete and execute the <br />Declaration of Covenants contained in Exhibit C and forward it <br />2. <br />'to:A
