Zoning File #1690 <br />October 15/ 1991 <br />Page 2 of 3 <br />Discussion <br />Both Sections 10.22/ Subdivision 2, and 10.55/ Subdivision <br />8/ do not allow "hardcover/ temporary or permanent structures" <br />within 75* of the shoreline. The definition of hardcover <br />includes any structure, blacktop, or other material which <br />Interferes to any degree with the direct absorption of rainfall <br />into the ground. It is staff's opinion that any "mobility" <br />attributed to this structure is inconsequential, in that during <br />any period of time it is located in tha 0-75* zone it is <br />functioning as hardcover, and it has the same mobility as a <br />garden shed or similar accessory structure. <br />A mxtigating circumstance is that this property was the <br />subject of an extensive hardcover review as recently as 1980, at <br />which time the previous owners were required to remove a small <br />storage shed in the 0-75* zone in exchange for attaching a third <br />garage stall at the north end of the house. Hardcover was <br />strictly limited per attached Resolution #2424. <br />Since that construction in 1988, the property has changed <br />hands and the recent site inspection indicates significant areas <br />of new rock and fabric on the property as well as areas covered <br />with brick pavers, all within the 0-75* zone. The building <br />inspector's sketch indicates approved hardcover areas per <br />Rresolutlon #2424, and those areas which have been added. <br />Issues To Be Resolved <br />1. Does the skate board ramp constitute a "temporary or <br />permanent structure" in the context of Section 10.22, <br />Subdivision 2 and 10.55, Subdivision 8? <br />2. Regardless of its structural status, does the skate <br />board reimp constitute hardcover? <br />3. If the ramp is a "temporary or permanent structure" is <br />it subject to the pertinent zoning ordinances regarding <br />setbacks, hardcover, etc.? <br />If the answer to any of these questions is in the <br />affirmative, then the applicant should be advised to remove the <br />ramp. His other option would be to apply for a variance to <br />hardcover and lakeshore setback for accessory structure. If the <br />answer is no to each question, does Planning Commission wish to <br />consider whether there should be zoning standards for skateboard <br />ramps? <br />I <br />j <br />i <br />to* -1
