I <br />I <br />To:Planning Commission Chairman Kelley <br />Orono Planning Commission Members <br />City Administrator Moorse <br />From: <br />Date: <br />Jeanne A, Mabusthr Building & Zoning Administrator <br />October 11, 1991 <br />Subject: #1688 Jim Buranen, 1085 Brown Road South - <br />Appeal - Public Hearing <br />Pertinent Ordinances <br />Section 540 Home Occupations. <br />Subdivision 1 - License Required. It is <br />unlawful for any person to engage in, or carry on, <br />a home occupation, as that term is defined in the <br />Zoning Chapter of the City Code, without first having <br />obtained a license therefore from the City. <br />Subdivision 2 - Regulation. Licenses will only <br />be issued if the specific use is permitted or <br />otherwise allowed by the Zoning Chapter, and if all <br />conditions set forth in said chapter are fully <br />complied with. <br />Section 1020, Subdivision 4(C) - Home Occupations. <br />Any gainful occupation meeting all of the following <br />requirements when engaged in only by persons residing <br />in their dwelling, when there is no employed assistant, <br />when that occupation is conducted within the principal <br />structure only, when evidence of the occupation is not <br />visible from the street, no signs other than those <br />permitted in "R" districts are present, no excessive <br />stock in trade is stored on the premises, over the <br />counter retail sales are not involved, the entrance to <br />the home occupation is gained from within the structure, <br />and the use does not adversely affect the character of <br />the uses permitted in the district in which it is <br />located. <br />Section 10.06, Subdivision 3(B)(1)(a) - Zoning; Appeals <br />and Adjustments. <br />Appeals to the Planning Commission may be taken by <br />any affected person upon compliance with any of the <br />conditions imposed by the Zoning Chapter. The Planning <br />Commission may hear and decide appeals where it is <br />alleged that there is an error in any order, requirement, <br />decision, or determination made by an administrative <br />officer in the enforcement of the Zoning Chapter. <br />n <br />1i <br />1 <br />#
