Use Perm.it <br />Dear Tom: <br />The City is in receipt of your lette: of April 29, 1991 and <br />the updated survey as requested during thir conditional use permit <br />review. Staff has enclosed the vacation application. Please <br />note the 1991 meeting and deadline schedule information is listed <br />within the handout information. <br />I have also enclosed a variance application. You should be <br />aware that the City of Orono will require variance approval of <br />the swimming deck/dock to be reconstructed in its present <br />configuration. The decking is located above the 929.4' elevation <br />and the reconstrv*ction would require approval of hardcover and <br />setback variances within the lakeshore protected area. (0 — 75 <br />setback area). <br />I cannot remember if I sent you Suesan Pace —Shapiro's <br />opinion dated January 30, 1991, but I have enclosed it for your <br />review and comment. It would appear that your status as a for- <br />profit organization will have no impact on the standards set <br />forth in our ordinances. The City Attorney's opinion confirms <br />that it is not necessary that a private club, association or <br />group of unrelated individuals be a ncn-profit club or <br />association, <br />Her opinion has raised other considerations regarding <br />membership of your organization at a maximum 200 member level. <br />The potential of 200 members is based on shared so1 d to <br />individuals and not family members. You will note in my original <br />review memo we addressed the fact that total m*..mbership must <br />Include family members.
