To: <br />61891.1 <br />Jeanne Mabusth, Building 6 Zoning Administrator <br />From Lyle Oman, Building Official <br />te:June 18, 1991 <br />Fox Stre IC,xo <br />As you know, the existing home at Fox Street was burned <br />by the Long Lake Fire Department and the foundation and a section <br />of asphalt driveway was knocked down into the basement and the <br />hole was covered over with dirt, all without the benefit of a <br />demolition permit which would have notified the applicant of the <br />requirement for clean fill. <br />The Building Inspection staff's position on the matter is as <br />follows: <br />■IS- <br />Vi <br />1. <br />1. All cities require demolition permits for principal <br />structures. <br />2. A contractor that builds million dollar plus houses <br />should know a permit is required. <br />i <br />*■ <br />3, Inspection staff doesn't normally remind contractors to <br />get permits (i.e. plumbing, mechanical, electrical, septic, <br />well, fireplace, etc.). <br />4. Demolition permits are necessary for property tax <br />purposes. <br />5. Removal of the foundation at this point would not <br />require much more work now than before it was covered over. <br />The top soil can be striped and stock piled in a short <br />period of time and the rubble can then be removed as it <br />would have before it was covered over. <br />Applicable Code Section: <br />Uniform Building Code Section 301. (a) Permits <br />Required. No building or structure regulated by this <br />code shall be erected, constructed, enlarged, altered, <br />repaired, moved, improved, removed, converted or <br />demolished unless a separate permit for each building <br />or structure has first been obtained from the building <br />official. <br />Orono Municipal Code Section 10.03, Subdivision 19 ~ <br />Clean Fill (see attached). <br />M.P.C.A. 7001.3050 Permit Requirements. Permit by Rule <br />— If in compliance with requirements, P.C.A. <br />notification is required - location standards are to <br />followed - closure standards are to be followed - <br />notification on property deed required, other rules <br />must also be followed (code sections enclosed). <br />6
