Box 66 <br />Crystal Bay, Mn.55323 <br />RE: After-the-fact Hardcover Variance for property located <br />at 2780 Shadywood Road. <br />Dear Planning Commission and City Council: <br />Enclosed, please find my application for an after-the-fact <br />hardcover variance for my property. <br />At this time, I would like to state that my position in <br />applying for this variance is to comply with the city codes <br />that"require me to do so. However, after consulting with <br />several landscape professionals, a civil engineer, and <br />a member of the Watershed Commission, I must question the <br />legality of our current Hardcover Ordinance. I do not feel <br />the above aftei -the-fact hardcover variance is necessary due <br />to the following objections: <br />1. PREEXISITING CONDIIIONS- When this property <br />was purchased,the hardcover was 29.17o. '^he <br />replacement of tne rotten deck created 29.7% <br />hardcover,due to the extension for a catwalk <br />area which would lead to the rear area of home. <br />2. DECKS ARE NOT HARDCOVER- decks should not <br />be classified as hardcover. They do not impede, <br />or increase the run off of water. Only the cement <br />slabs, or permanent impervious surfaces underneath <br />a deck should be calculated as hardcover. <br />3. UNDUE HARDSHIP- the extension for a catwalk <br />to the rear of the home is necessary for safety <br />reasons. The home is a split level home, and <br />there is no exit from the rear of the home cn <br />this level, which is a main living area. The <br />catwalk will be under the eaves of the home, <br />with lawn directly underneath, thus creating <br />no addtional hardcover. <br />I would like to thank you in advance for considering tne <br />above information, not only in my particular situation, but <br />also for future property owners in Orono.
