At that time, the <br />City of Orono or the Minnehaha Watershed District had a 75' setback requirement. <br />When the Watershed District adopted Its 75* setback from the Iske, I Informed <br />Mr, McCaffrey that ho would have to get a variance from the Watershed District. <br />Fnclosed you will find a letter from the Watershed District conflrit j the <br />fact That Mr. McCaffrey was grante"* a variance for the location of his home. <br />Since this time, the City of Orono has adopted Its own 75* setback requlre- <br />menr, and Mr. McCaffrey was not Informed of that until just recently. <br />Nonreliy, a petifloner who requests a variance Is referred to the Planning <br />Commission, but Mr. McCaffrey has asked If the Council wi'l act on this rotter <br />wither the Planning Commission's recommendation since he has already received <br />the aoproval of the Minnehaha Creek Watershed District, and has made plans to <br />start construction of a home the week of May 20, 1974. !n addition, Mr. McCeffrey <br />needs a variance from the moratorium. Since Mr. McCaffrey Is planning fo construct <br />a sealed system, there should be no problem with granting this variance. <br />rr* <br />’.‘--.J
