CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> NO. 7306 <br /> ICESH0°' <br /> A RESOLUTION <br /> AMENDING RESOLUTION NO. 7179 <br /> APPROVING VARIANCES FROM <br /> MUNICIPAL ZONING CODE <br /> SECTIONS 78-305; 78-1279; AND 78-1680 <br /> FILE NO. LA21-000030 <br /> WHEREAS, on April 20, 2021, Thomas C. Bergstrom and Kathryn A. Bergstrom, <br /> husband and wife (hereinafter the "Applicants"), applied for variances from the City Code for the <br /> property addressed 1509 Long Lake Boulevard and legally described as: <br /> Lot 22, and the East half of Lot 21, ALBEE'S LONG LAKE ADDITION, Hennepin <br /> County, Minnesota (hereinafter the"Property"); <br /> WHEREAS, the on June 28, 2021, the Council approved Resolution No. 7179 <br /> which granted variances to permit the following: construction of a deck and stair located within <br /> the 50-foot rear setback; and construction of a deck and stair within 75-foot lake setback; and <br /> hardcover within the 75-foot setback area for the new improvements <br /> WHEREAS,the Applicants have requested an amendment to Resolution No. 7179 <br /> to allow modifications to the lakeside deck to permit the stairs to be constructed in the southeast <br /> corner of the deck within the 50 foot rear yard setback. The size of the deck will remain as <br /> approved; and <br /> WHEREAS,the new stair location will result in an increase in the overall hardcover <br /> by 5 sq.ft. Following the conditions of Resolution 7179, 330 sq.ft of existing hardcover must be <br /> removed from within the 75 foot lakeyard setback. The proposed increase will be outside of the <br /> 75' lakeyard setback and will result in 3905 sq.ft of total hardcover for the overall property creating <br /> a 24.04% total hardcover for the property. <br /> WHEREAS, on October 24, 2022, the City Council reviewed the revised plan, and <br /> finds the revised plan is consistent with findings outlined within Resolution No. 7179; and <br /> NOW, THEREFORE, BE IT RESOLVED that on October 24, 2022, the City <br /> Council of Orono, Minnesota hereby approves the rear yard setback, the 75' lakeyard setback <br /> and hardcover variances as revised according to the revised plan attached as Exhibit A; <br /> CONCLUSIONS, ORDER AND CONDITIONS: <br />
