This application is regarding a guest house conditional use permit. <br /> <br />2. MN§15.99 Application Deadline. The application was received and was considered to be complete <br />on August 17, 2022. Therefore the 60-Day review period expires on October 16, 2022. <br /> <br />3. Background/ Summary. The applicant wishes to construct a new 971 square foot accessory <br />building which will function as a guest house. The property is 4.6 acres in area within the LR-1A zoning <br />district where 2.0 acres is the minimum size. A conditional use permit (CUP) is required for the guest <br />house use. A minimum of 4.0 acres is required for a guest house use in this district. <br /> <br />4. Planning Commission Vote and Comment. On September 19, 2022, the Planning Commission held <br />a public hearing. Following the public hearing the Planning Commission voted 7 to 0 on a motion to <br />approve the requested conditional use permit subject to property owner’s agreement to the filing of a <br />covenant in the title of the property assuring that the guest house will not be used for a home occupation <br />unless specifically approved by the city or if allowed by Code; and will not be rented, or leased under any <br />circumstances. Staff recommends an additional condition of approval that the existing septic system be <br />upgraded appropriately to serve the additional bedrooms in the guest house. <br /> <br />5. Public Comment. No comments from the neighbors were received. <br /> <br />6. Staff Recommendation.
