The City Council should hold a public hearing, review and take action on application <br />LA22-000049 in order to authorize a zoning amendment of the official wetland district map. <br /> <br />2. Background. The official City Wetland Map identifies the boundaries of the wetland overlay <br />district. This map includes wetlands within the City of Orono as defined by the Wetland Conservation Act <br />(WCA). Additionally, approved WCA wetland delineations are included in the boundaries of the wetland <br />overlay district. Following City Code 78-1609, in order to remove a wetland from the overlay map a <br />rezoning process is required. A wetland delineation was completed for this property was approved by the <br />MCWD in 2021. <br /> <br />The development of the Public Works building involves filling a portion of the delineated wetland on the <br />property. City Code requires the city to process a rezoning amendment to the wetland overlay map. The <br />development of the site requires filling/removal of 0.41 acres of wetland on a 9.7 acre property. A review <br />of the hydrological and ecological effects and function of the site was completed in the wetland <br />delineation report and as part of the wetland alteration permits issued by the Minnehaha Creek Watershed <br />(21-698) and WCA (W21-060). There were no available local sites to create wetland replacement. On-site <br />mitigation is not a viable option due to spatial constraints on the site. Credits will be drawn from within <br />the same major watershed No. 20 – Mississippi Metro. The Council should consider if the wetland map <br />amendment is consistent with the goals and policies of the community management plan. <br /> <br />COUNCIL ACTION REQUESTED <br />1. Hold a Public Hearing regarding the rezoning the subject wetland area to remove it from the <br />Wetland Overlay District. <br />2.
