The applicant is requesting setback variance approval to place a new monument sign on the <br />street lot line where a setback of 5 feet is required. <br />2.Background. The applicant is requesting <br />approval of a variance for a 0-foot setback <br />from the street property line. A 5 foot setback <br />is required from all property lines for a <br />moument sign. The proposed sign is 9’ x 1.4’ <br />and will be 7.3 feet tall which is a conforming <br />size. The monument sign will include the <br />business name, a digital changable signage <br />area, and a faux stone base. <br />The property currently has a 8’ wide sign <br />installed on two 4”x 4” posts, located between <br />the building and the pavement of County Road <br />15. The existing sign is situated over the <br />property line and encroaches two feet into the <br />right-of-way. The existing sign is also located <br />over a utility easement; the new monument <br />sign is proposed to remain within the utiliy <br />easement. The proposed plan would remove the <br />current sign which encroaches into the right-of- <br />way with a new sign at a 0-foot setback. <br />3.15.99 Deadline. The applicant made a complete application on July 20, 2022. The 60-Day review <br />period ends on September 19, 2022 <br />4.Planning Commission Vote and Comment. The planning commission held a public hearing on <br />August 15, 2022. No comments from the public were made during the public hearing. The Commissioners <br />discussed their concerns with the proposed encroachments into the setback and the proposed digital display <br />on the sign. Commissioners noted the digital display proximity to the road was not supported. The <br />Commission voted 3-2 (Erikson and Kraemer) to deny the variance request. The draft meeting minutes are <br />attached as Exhibit D. <br />5.Public Comment. No public comments were received. <br />6.Staff Recommendation. Staff finds there are conforming building locations which would meet the <br />setback requirement. Any encroachment in the utility easement would require an encroachment <br />agreement.
