Olson, City Planner July 26, 1983 <br />DEVELOPMENT REVIEW #766-767-768 <br />ISSUE #3: REZONING (File #768) <br />This question should be the least controversial and easiest to <br />answer. <br />The request is to rezone a strip of land approximately 50 ft wide <br />X 1,276 ft long from RR-IB to B-1. The practical effect is to <br />move the B-1 District boundary north to align it with the north <br />line of .the existing Wear property, to include all of the existing <br />buildings on the Reber property, and to facilitate more logical <br />lines for subdividing the residential property from the commercial <br />property. <br />Mr. Reber and Mr. Wear made this exact same request in application <br />#308 which received preliminary Council approval on February 23, <br />1978. The rezoning was never finalized at that time solely because <br />Ml. Reber never returned to complete his concurrent subdivision <br />application. <br />There is nothing in the record to indicate why the existing zoning <br />district was legally described as it is, or why this description <br />cuts thru the rear of the Wear property. <br />RECOMMENDATION; Planning Commission and Council should conceptually <br />reapprove this rezoning request to be finally approved at the <br />same time as Mr. Reber receives final approval for his proposed <br />subdivision, thereby assuring that the zoning line will follow <br />legally described lot lines and not bisect lots as it does now. <br />PRELIMINAF
