Mabusth <br />DATE:September 15, 1983 <br />SUBJECT:#758 James Bigham, 1545 Long Lake Blvd - Conditional <br />Use Permit - After the Fact <br />Zoning District - LR-lA <br />Application - Conditional Use Permit - After the Fact - <br />Required for erection of retaining walls per <br />Ordinance 31,700 portions of which are located <br />within 25* public access. <br />Bigham constructed the retaining walls in the fall of 1982 and <br />the City staff began discussion with applicant about its removal <br />sometime in March of 1983. In later discussions, Bigham was <br />given the opportunity to file an after the fact application to <br />ask the City Council to review his request and made a decision <br />as to the disposition of the structure. <br />The wall is constructed of 6" x 6" treated timbers 8* in length. <br />The wall is constructed in two Tiers with an upper boxed section <br />at"the northeast edge. This boxed separated section contains <br />two drainage pipes ~ one from the foundation and the other from <br />the roof. These pipes drain onto Ivy Lane. <br />The City has held off with the review of this application awaiting <br />the completion of a variance application by the applicant for <br />a proposed addition to his home. The City can delay no longer <br />and has scheduled the application for review. The delays were <br />not caused by the applicant but rather by negative septic tests <br />and the need to perform additional septic test. <br />City Engineer has reviewed the location, construction and <br />design of the retaining walls. His recommendation is enclosed <br />for your review. Briefly, he recommends that the boxed upper <br />section of wall containing the drainage pipes be removed and <br />drainage directed off Ivy Lane right of way. The remainder <br />of the retaining wall can remain as long as the owner is placed <br />on notice that at some future date, the City may have to <br />ask that the retaining wall be removed. <br />Bigham appears to be planning additional alterations in his <br />lakeshore yard - more retaining walls within 75 of Long lake. <br />I would suggest that Bigham expand his application to include <br />the lakeside retaining walls and that these retaining walls be <br />located on a survey. <br />If he does not wish to include the lakeside retaining walls, he <br />must be advised that a separate conditional use permit will <br />be required at a later date. <br />■5 n <br />...
