Brauchle <br />Holmes & Graven <br />470 Pillsbury Center <br />Minneapolis/ MN 55402 <br />Re: <1761 Douglas Smith/ 3237 Casco Circle - Variance Application <br />Dear Mr. Brauchle: <br />As I attempted to explain to your client/ Douglas Smith/ the Planning <br />Commission has recommended tabling his lot area and lot width variance <br />application pending the completion by the City of a study involving <br />lots held in common ownership since 1967 when the zoning districts <br />were established and the need to establish new standards for <br />determining the buildability of such properties. <br />At present/ the City requires all lots held in common ownership to <br />meet 100% of all lot standards for a zoning district as opposed to <br />single separate lots that need only meet 80% of those same standards. <br />Mr. Smith's application was accepted as a lot of single separate <br />record requiring variance review because the area and width of Lot 18 <br />did not meet the 80% requirement. It was in the review process <br />that the common ownership of Lots 16/ 17 and 18/ Spring Park Addition/ <br />was revealed. <br />Staff has been screening all proposed lot area and width variances <br />for common ownership involvement and advising residents to wait <br />until we have established new standards for review rather than adopt <br />an ordinance for a moratorium.
