S. Highways 1.05 <br />S. S. 412.851 <br />The City is in receipt of a petition for the vacation of Charles <br />Street. Charles Street was platted as a part of the Orono <br />Orchards plat with a 33 foot wide right of way. The 33 feet <br />does not meet current standards for a city road. Staff agrees <br />with the petitioners given the current pattern of development <br />and use of the surrounding properties there is no need for <br />a public road connecting intersecting roads [Woodhill Road and <br />Lyman Avenue [Lane]]. <br />Larry Berg representing Woodhill Country Club has called to <br />question the purpose of the vacation. I advised him that the <br />wetlands area intersecting both pjtitioners' properties will <br />still hold them at the two unit level. He was concerned that <br />the acquisition of the additional footage would create new lots. <br />I understand Berg will be present for the public hearing. <br />It would appear based on S. S. Highways 1.05 that the petitioners <br />as original fee owners of the subject street will acquire the <br />entire 33' strip. <br />Although statute does not require that all abutting property <br />owners sign a petition of vacation, I strongly recommend that <br />Woodhill Country Club respond in writing to the proposed vacation <br />before City approves vacation. <br />Staff Recommendation <br />To approve the vacation of Charles Street as described in the <br />plat Orono Orchards based on the following findings; <br />m <br />rn <br />4 <br />I <br />\'i <br />Kv: <br />Pl2 <br />Jur <br />pac <br />JA^
