Gabriel Jabbour was <br />present from the audience for this application. <br />Mabusth noted that this involves a standard in the <br />L.N.C.D. code, which the City has adopted, regarding <br />setbacks for docks based on the extended side lot lines <br />for Nr. Hoch*s property, which converge at a 63' point. <br />Mabusth noted at a 60' point his dock should be 15* from <br />those extended lot lines therefore he is asking for 0 <br />setback variance. Mabusth noted that in this <br />neighborhood that all the lots have this problem. <br />Mabusth noted that the LNCD limits the applican^to one <br />boat. She asked when Nr. Hoch constructs th4<dock, <br />based on the understanding of the neighbors as stated <br />in the signed affidavits, that the dock and boat will <br />not extend beyond their lot lines. <br />Mr* Hoch noted that it would include the width of his <br />boat and that both the beat and dock would not encroach <br />over the extended lot lines. <br />Gabriel Jabbour noted that heli^iS no problem with Mr* <br />Hoch's placement of the dock, but that in the future if <br />Nr. Hoch sells, a new owner could come in there with a <br />bigger boat. Jabbour noted that he has no problem <br />with the proposed dock placement provided that the <br />neighbor next to him has no problem and so on. <br />Rovegno moved to approve a variance for the boat/dock <br />setback requirements in the authorised dock use area <br />at 875 Partenwood Road based on the following <br />conditions: <br />it1.
