Zoning File #1003 <br />January 14, 1986 <br />Page 2 <br />Staff asks that you consider the condition of '72 that also asked for <br />an open space easement over Lot 6. In the Planning Commission minutes of <br />7/5/72, it is noted that applicant uses Lot 6 for lake access only. It is <br />not clear in the minutes of '72 if the open space easement was required as <br />a credit for the substandard areas of rearranged lots or to formally define <br />the lot as unbuildable and recognize riparian use of lot. <br />Staff would suggest that the directive of '72 be upheld by requiring <br />an open space easement over Lot 6 and that applicant file a special lot <br />combination that would formally recognize the riparian rights of Weiler. <br />Staff Recommendation <br />To approve the lot line rearrangement subdivision application of H. <br />Weiler and D. Kempf based on the following findings. <br />1. All structures meet required setbacks from newly defined shared <br />lot line. <br />2. Council granted approval of proposed division in 1972. <br />3. Current division is required to bring existing structures into <br />conformance with code. <br />B.f . <br />Approval subject to the following conditions: <br />1. Kempf to combine Lots 23, 30 and rearranged 22 & 31. <br />2. Weiler to combine Lots 20, 21, 32, 33 with Parcel C. ^ ^ <br />3. City to ask for open space easement over Lot 6 because of sub­ <br />standard building sites. <br />4. Weiler to execute special lot combination with City formally <br />approving riparian use of Lot 6 by Weiler and recognizing special <br />ownership relationship (Lot 6 cannot be sold as separate parcel).
