Note the old survey of 1982 and current survey do not designate <br />old drive from Kelly Avenue access. Staff would suggest that a drive <br />and parking area would have brought existing hardcover within 250-500' <br />zone over the allowed 30%. <br />The applicant proposes 18% of hardcover improvements within the <br />75-250' zone. The excess of hardcover in the 250-500' zone is <br />balanced out with additional allowance within the 75-250' zone. <br />Applicant should be advised of the need to limit improvements to <br />property that create hardcover in the future. In addition, it should <br />be noted that excess in hardcover is located in zone furthest away from <br />lakeshore. <br />The side setback variance will allow the new owner to save the same <br />mature trees referred to in 1982 application. <br />Staff Recommendatioh <br />To approve a lot area variance of 38%, a side/.-treet setback <br />variance of 25 feet or 71% and a hardcover variance of 8% within the 250- <br />500' zone based on the following findings: <br />1. The property has contained a residence since 1902. <br />2. Sewer and water is available and has been assessed and paid for <br />the property. <br />3. Previous residence was located 15 feet from Walters Port Road. <br />4. To relocate house further west would require the 3oss of <br />several mature trees. <br />Approval is subject to the following conditions <br />1. Applicant must obtain a building permit for new dock. <br />2. Applicant is hereby advised that a future Council may not <br />approve setback or hardcover variances for this property in <br />consideration of the total hardcover and location of house on <br />property.
