Brad Van Nest <br />July 12, 1985 <br />Orono City Council & <br />Planning Commission <br />Subject: Lyle Rahn Variance Application <br />Dear Ladies & Gentlemen: <br />Because I was a member and Chairman of the Orono Planning <br />Commission during the period that the original variance <br />was granted to Mr. Lyle Rahn for the construction of a home <br />at 1146 Wildhurst Trail, I have been asked to review this <br />file. <br />I have reviewed the file and to the best of my recollection, <br />can remember no other stipulations other than those that <br />are clearly stated in the minutes of the Orono Planning <br />Commission meeting of April 18, 1974, the minutes of the <br />Orono City Council meeting of April 22, 1974, and July 28, <br />1975. <br />The granting of a variance to allow a home to be constructed <br />on a substandard size lot when said lot was in single separate <br />ownership and connected to municipal sewer was consistent <br />with the actions of the Orono Planning Commission and City <br />Council during this period. All of the information that <br />I have reviewed and my recollections of this matter indicate <br />that the approval to grant a variance was based on the agree <br />ment that the existing cabin which partially lies within <br />75 feet of Lake Minnetonka would be removed after the <br />construction of the new house. This requirement was also <br />consistent with the Orono Planning Commission and Council’s <br />actions involving existing structures that are within 75 <br />feet of the lake. To my recollection, the City has never <br />approved a lot size and width variance for the construction <br />of a new home that would allow the continuance of an existing <br />structure that was within the 75 foot lakeshore setback. <br />I hope that this information is useful in your deliberation <br />of this matter, and if 1 can be of any further assistance, <br />please feel free to contact me at your earliest convenience. <br />Thank you for your cooperation in this matter. <br />Yours truly. <br />William B.
