However, the response at that time was <br />based on McEnany being the sole owner of the proposed garage. Now, <br />with the association as owner and the individual unit owners as <br />leasees, staffs view is that the proposed garage would not be in <br />violation of the density credit clause. Also note that this is not <br />the first time an association has proposed or constructed an accessory <br />structure on an Outlot within a PRD (Re: Ned Dayton's French Creek <br />project). In effect, any structures on a PRD outlot must be the pro­ <br />perty of the association or the developer, and may not be owned by <br />individual property owners. <br />Staff would recomend approval of the requested variance to <br />Section 10.03, Subdivision 9 (A), finding that the garage will be <br />owned by the Association and meets all pertinent performance <br />standards.
