Wh re the provisions of <br />this o dinance \ uld cause the authorized / pcJ: use area of two or <br />more s .tes to o jrlap, or where there is «:iy other unusual con- <br />.ion of s ireline or extended lot lines, which causes a <br />conflict betweei the owners of two or more adjacent or nearby <br />sites as the use^of the same area of the lake for docks, mooring <br />areas or other structures or for reasonable access thereto, the <br />owner of any of the affected sites may apply to the Board for a <br />variance pursuant to Section 3.04. A variance may be (a) to <br />permit the^ applicant to locate a dock, mooring area or other <br />st^cture in a Location different from that permitted by this <br />ordinance or (b) to permit or require the owner of any adjacent or nearby site to do so. j j <br />Subd. 8. locks; Dimension Limits. A dock as defined in <br />Section 3.01, S ibdivision 2, may exceed six feet, excluding <br />pos*ts# in eitihc] its length or widths but not both; provided <br />however, that do^ks which are in existence on June 30, 1982 and <br />which are in coirpliance with all the provisions of the LMCD Code <br />o^er ^an this Section 3.02, Subd. 8 shall be allowed to con <br />tinue in their j>resent form without expansion or modification <br />until such time as such dock;, are replaced or until 50% or more <br />of any such dock is damaged or destroyed. (As amended. Ord <br />Ko. 12, Sec. 2; ord. No. 55.) <br />. Subd. 9. S.ioreline Requirements. a) No new docks or moor— <br />ing &r£&s other th&n cominercial docks shall be constructed or <br />established which provide space for or are used for mooring or <br />docking a greater nu^er of watercraft than one for each 50 feet <br />of continuous si >reline in existence on May 3, 1978. When mea <br />surements detern ning the number of watercraft allowed result in <br />the provision ol a fractional watercraft, any fraction up to and <br />including one ha f (1/2) shall be disregarded, and fractions over <br />one half (1/2) shall allow one additional watercraft. (As <br />Amended Ord. No. 40) <br />t <br />b) fewer^ watercraft may be kept at any dock or <br />mooring facility which is otherwise in compliance with this code <br />and with the reqi?irements of the local land use control authority <br />and which is located on a site which i£ in existence on <br />August 30, 1978.
