STATEMENT OF FACTS AND ARGUMENT <br />IN SUPPORT OF ISSUING BUILDING PERMIT TO <br />SHAVER CORPORATION OF WAYZATA FOR DOCK TO BE <br />CONSTRUCTED ON A PART OF LOT 9, NORTH SHORE COTTAGE ACRES <br />1. Present owner of Property: <br />Lakeville Elevator Company, a Minnesota corporation <br />See Deed — Exhibit 1 <br />2. Legal Description of Property; <br />That part of Lot 6, North Shore Cottage Acres, <br />Lake Minnetonka, lying Northwesterly of the following <br />described line: Commencing at the most Easterly <br />corner of said Lot 6; thence Northwesterly along <br />the Northeasterly line of said Lot 6 a distance <br />of 40 feet to the point of beginning of line to <br />be described; thence Southwesterly parallel with <br />the Southeasterly line of said Lot 6 to the South­ <br />westerly line of said Lot 6 and said line there <br />terminating. <br />And that part of Lot 9, North Shore Cottage Acres, <br />Lake Minnetonka described as follows; Commencing <br />at the Northwest corner of said Lot 9; thence South <br />along Westerly line 25 feet; thence at an angle <br />Southeasterly parallel with Northeasterly line <br />25 feet; thence at right angles Northeasterly <br />parallel with Westerly line 25 feet to Northeasterly <br />line also being the County Road; thence Northwesterly <br />to point of beginning. <br />For ease of reference and discussion, the parcel which <br />is a part of Lot 6, anc on which a residence will be <br />constructed is hereinafter called Parcel A. <br />The parcel which is a part of Lot 9 is hereinafter called <br />Parcel B. <br />See Deed — Exhibit 1 <br />3. Physical characteristics of Property; <br />Parcel A is primarily low and marshy land, with buiid;rg <br />site on Southeasterly portion. The Ferndale Road right- <br />of-way runs over southwesterly 33 feet of Parcel A.
