The keeping of domestic animals for <br />non-commercial purposes including horses for the use of the <br />occupants of the premises, provided that any accessory building <br />used for housing such animals shall be located not less than 150 <br />feet from the nearest lot line. A minimum of one acre in <br />agg^-egate, exclusive of one acre for the principal building, must <br />be available for each animal unit, except as hereinafter set forth. <br />A minimum of two acres of open pasture must be available for a <br />single horse and one additional acre must be available for each <br />additional horse. When the horses are kept stabled and do not <br />require pasture for feed purposes, the minimum pasture requirement <br />may be adjusted at the discretion of the Council. Such minimum <br />pasture acreage shall not include low lying lands unusable for <br />pasture or grazing. Any person keeping such animals must comply <br />with the provisions of the City Code. <br />REVIEW OP APPLICATION: <br />In response to a persistent neighbor's complaint concerning an in­ <br />crease in commercial activity and commercial use of the Kokesh property, <br />the applicant has filed an appeals application in order to determine if a <br />land use application is required. <br />REVIEW OP OPERATION: <br />The Kokeshes have operated their "stock farm" prior to 1975 - per <br />Section 10.03, Subdivision 18, farms in existence on that date are <br />permitted to operate without a conditional use permit as long as the stock <br />is not increased more than 25% with stock over a year old. A conditional <br />use permit is required if there is an increase in stock greater than 25%. <br />The Kokesh homestead consists of 25+ acres. They kept 20 horses in 1975 <br />and they now keep 25 horses. There has not been r*• crease of more than <br />25% in stock - per this section no need for a condit al use permit. <br />In the applicant's letter of September 1984 and in their attorney's <br />addendum to the application, there is discussion of the various activities <br />or uses associated with their stock farm operation: <br />1. Raise, train, buy, sell thoroughbred horses - they now race their <br />own horses in Minnesota <br />2. Board horses <br />3. Training or riding academy - lessons provided on site <br />4. Sale of tack <br />The applicant's attorney is correct, many activities are noted in the <br />definition section but nothing has been specified in the zoning district <br />designating these uses or activities as permitted or conditional uses or <br />accessory uses.
