The setback, hardcover, and septic require­ <br />ments have been adequately met, but because a fair portion of the interior <br />area of the lot is below the 931.5' flood plain elevation, applicants are <br />proposing to fill portions of the interior and cut portions near the lake- <br />shore. The resulting elevations provide equivalent areas of cut and fill, <br />so there is no net effect on the flood plain. <br />In the 0-75' setback area, the cuts average about 6" overall. The <br />slope is nearly fiat in the 0-75' area, and the soil is quite sandy, hence <br />there is no substantial effect on the run-off patterns at the site. Note <br />also that a small curved built-up terrace is proposed near the house. <br />Portions of this fill are essential to the project in order to provide <br />protection for the footings. No hardcover is proposed or allowed in this <br />area. The terrace will have no appreciable effect on the run-off patterns <br />of the site. <br />The applicants have been granted approval by the Minnehaha Crrek <br />Watershed District for this project. City Engineer, Glenn Cook, has re­ <br />viewed the site and grading plan and has no problem with it. <br />You will recall that this lot was granted a lot area variance per <br />Resolution #1755 in May 1985. <br />Staff recommends approval of the conditional use permit for filling <br />and cutting in the flood plain and 0-75' lakeshore setback area, subject to <br />the condition that suitable lakeshore protection measures are provided to <br />eliminate any sedimentation into the lake.
