Chaska has acquired two of the four parcels <br />involved, both or which are bound on at least one side by properties still <br />used residentially (see Exhibit H.) The Marina Committee and City Council <br />have insisted that separate land use applications be made for each of the <br />two separated properties, in as much as each substandard sized property <br />currently contains a mixed use, with Marina employees or renters occupying <br />the respective houses on the lots while employee parking and boat/trailer <br />storage is also taking place on the same properties. <br />In general, when the property between Gayle's and Chaska was rezoned <br />from residential to B-2 commercial in the mid 1960's, the lisidential uses <br />became legal non-conforming. Any change to commercial use requires a <br />commercial site plan review and a certificate of occupancy for the new use. <br />The Planning Commission's task is to review the proposed usage of these <br />properties, realizing that our code has no specific performance standards <br />for the mixed use, hence it is necessary to decide which residential or <br />commercial standards apply. <br />The Marina intends to demolish the house at 3340 as soon as possible. <br />The intent is less clear for the house at 3350. Should the mixed use <br />within this property be allowed to continue? Which use is primary? Which <br />standards should apply? <br />Finally, realize when discussing "mixed use" that we are dealing with; <br />1. mixed commercial/residential uses within a given piece of <br />property, i.e. house and storage on same lot
