1 <br />City of Orono <br />July 30, 1985 <br />Page Three #952 § <br />The current use is a permitted use that is supported by Section 10.27 <br />which holds that the purpose of RR-1A is to provide a combination of low <br />density residential and limited agriculturui activity. This definition of <br />"agriculture" provides the land owner with the right to make a profit. <br />All of the buildings being used within the area are a permitted use within <br />the R-IA district. <br />Allegations have been made with reference to some commercial uses, i.e., <br />sale of tack and giving of lessons, but it would appear that this use is a <br />permitted accessory use. <br />Section 10.27 provides that tlie following should be permitted as accessory uses: <br />(a) "Any accessory use as regulated in "R-IA" district and <br />"animals" as regulated in Section 10.20, Subdivision 3, <br />Subparagraph (m). <br />Section 10.20, Subdivision 3, Subparagraph (m) makes reference to "Antenna <br />Structures", I assume the reference is to Subdivision 3, Subparagraph (k), <br />"Animals", which reads as follows: <br />"the keeping of a domestic animal for non-commercial purposes <br />including horses for the use of the occupants of the premises, <br />provided that any accessory building used for housing such <br />animals shall bo located not less than 150 fuet from the nearest <br />lot line. A minimum of one acre in aggregate, exclusive of one <br />acre for the principal building, must be available for each <br />animal unit, except as hereinafter set forth. A minimum of <br />two acres of 0£5en jiasture must be available for a single horse <br />and one additional acre must be available for each additional <br />horse. When the horses are kept stabled and do not require <br />pasture for feed purposes, the minimum pasture requirement <br />may be adjusted at tlie discretion of the Council. Such minimum <br />pasture acreage shall not include low lying lands unusable for <br />pasture or grazing. Any person keeping such animals must comply <br />with the provisions of tlie City Code. <br />This wo\ild be an extension and not a limitation on the pt^rmitted "stock farm'.
