This structure has existed on <br />the property since prior to 1974 when the applicant purchased the <br />property. This structure was the only structure on the property when <br />the applicant bought the property. <br />On April 1, 1974, Mr. Rahn submitted an application to the City for a <br />variance to build a new home on the 0.838 acre lot in a 1.0 acre zone. <br />This variance was subsequently approved by Council on April 22, 1974 , <br />conditioned on the existing cabin being removed. <br />Mr. Rahn did not obtain a permit for his new home within the one year <br />time limit, and his variance expired. He then in July, 1975, <br />reapplied and was again granted a variance on July 28, 1975 under the <br />condition that the old structure be removed within 30 days after <br />occupancy of the new structure. <br />Mr. Rahn subsequently obtained a building permit on August 4, 1975, <br />upon which appears the notation "approved by V.C. 7-28-75 conditioned <br />on removal of existing hcuse". The building inspector at that time <br />was Mike Scheller. The house would have been nearing completion about <br />the time Mr. Scheller retired on January 16, 1976 hence it is likely <br />that no followup ever occurred to verify that Mr. Rahn had indeed <br />fulfilled the conditions of that approval. <br />In the spring of 1985, Tom Jacobs became aware that Mr Rahn had already <br />completed some remodeling on the structure, and convinced Rahn that a <br />permit was requird, Jacobs being unaware that the structure was <br />illegally existing. Rahn obtained a permit for $25.50 based on an <br />$1,800 estimated corJtruction value (no plan review was required). <br />I
