MINUTES OF TUE ORONO PIJVNNING COMMISSION MEETING HELD JUNE 17, 198S- PAGE 3 <br />#876 ASPLUND <br />(Cont.) <br />Goetten stated that with the development of this property the <br />criteria was already established by the Council for this <br />development. Goetten asked when the criteria was <br />established for this property, was anything put in writing <br />regarding the lakes!.ore development standards. <br />Zoning Administrator Mabusth stated that the standards for <br />lakeshorc development were set out in the resolution along <br />with the special setbacks approved for this site. Mabusth <br />noted that in that resolution it was noted that all lakeshore <br />development standards would apply. <br />Chairman Callahan summarized the proposal for 3424 Eastlake <br />Street. Callahan explained that the applicant is willing to <br />remove the patios up to the 75' setback line. Callahan <br />stated that the applicant wants to put a rectangular piece of <br />concrete between the porch (proposed 10' x 10' ) and the bay <br />window. Callahan stated that new information submitted <br />notes that the applicant has placed plastic underneath <br />landscaping fence line. Callahan stated that staff has <br />noted that a certificate of occupancy has not been issued for <br />the home so it is possible to require the applicant to conform <br />to the overall hardcover requirements. Callahan asked that <br />the Planning Commission address the screened porch and <br />portion of patio. <br />Rovegno asked staff if poking holes in the plastic would make <br />the area non-hardcover. <br />Assistant Zoning Administrator Gaffron stated that Council <br />did accept that in another application. <br />1 ndy Asplund noted that he has already spent $3,500 in <br />landscaping and t > tear up the rock would cost another <br />$1,000. <br />Chairman Callahan stated that the credit may not be • easible <br />since this property is already overbuilt. <br />Kelley moved, Goetten seconded, to deny the applicant's <br />after-the-fact variance and request the applicant to do the <br />following; <br />1.Applicant is to remove all hardcover between the 0-75' <br />setback area and the City to hold the line at 25% <br />hardcover between the 75-250' setback area. <br />2. Applicant to remove all plastic m.aterials underneath any <br />landscaping. <br />3. Rectcngular piece of concrete to bo removed also. <br />Motion, Ayes (2), Nays (5). Members Kelley and Callahan <br />vote aye because the property is being over utilized in a two <br />acre zone. Motion failed. <br />;? <br />I
