#929 Lyle Rahn <br />Page 2 <br />June 13, 1985 <br />Upon inspection, the inspectorb noted that a deck had been placed in the <br />0-75' setback zone, and that a conditional use permit was required for <br />the guest house. Rahn was notified per the inspection slip to remove <br />the deck and that a conditional use permit was required for the guest <br />house use. Other construction items needing revision were also <br />noted. <br />Mr. Rahn applied for a conditional use permit in May, 1985. My file <br />investigation today revealed that the structure exists illegally per <br />the 1974 and 1975 variances, and per the conditions of the building <br />permit that was issued on August 4, 1975. <br />Staff recommends that the conditional use permit be denied based on the <br />above related facts, and that Mr. Rahn be ordered to remove the <br />structure within 30 days of Council's final action on this matter. It <br />is our opinion that Mr. Rahn has no legal right to keep this structure on <br />the property, and furthermore, it can be considered a non-conforming <br />structure because portions of it are less than 75' from the lakeshore. <br />i
