Beek (sewered property) <br />Required = 2 acres <br />Existing = .75 acres <br />Variance = 1.25 acres <br />2.#924 Jon Scherven (sewered property) <br />Required = 1.0 acres <br />Existing = .27 acres <br />Variance = .73 acres <br />Applications #856 & 924 dealt with sewered property. The application <br />proposes a major increase in water use with both kitchen and L?th. Lacking <br />the septic information, it is impossible to make any valid findings. We <br />are dealing with a rural property, the applicant must prove there is ade <br />quate area for septic expansion and, if a guest apartment is finally ap <br />proved, an alternate site should be located. The alternate site would have <br />to be protected from the encroachment of future construction. In con <br />sideration of the size of the rural let, if a guest apartment is approved <br />for the site, the applicants may be prohibited from building accessory <br />structures in the future. <br />I can find nothing in the previous guest house/apartment applications <br />in rural areas where there was a need for an area variance. The City <br />appears to hold firm to the performance standards for rural development. <br />I had talked with Mr. Pula about 2 months ago concerning the City's <br />position or rural properties and advised that he forget the apartment and <br />just go with a bedroom and bath. Pula has asked to go ahead with the <br />conditional use permit for guest apartment because of specific benefits in <br />the financing of the improvement (see Exhibit F). In consideration of the <br />Gaffron memo, I must now ask Mr. Pula if he plans to go ahead with just a <br />bedroom, that the tanks be pumped and the size of the drainfield serving <br />the residence be determined. <br />Alternative of Action <br />To deny conditional use permit for guest apartment on property located <br />at 2015 Webber Hills for one or more of the following findings; <br />1. The lot is 75% deficient of required area to support two <br />residential units. <br />2. Establish negative precedent in the review of similar guest apart <br />ment uses in rural zones. <br />3. Review Section 10.09, Subdivision 6 A 1-3 for other applicable <br />findings. <br />To table ponding receipt of necessary septic information. <br />J
