In <br />the process, he proposes to "square off" the left rear corner of the <br />house, and will no longer have a garage on the property. In tact, he <br />would requ i re extensive variances i f he ever wanted to place a garage on <br />the property in the future. He also proposes to arid a screen porch on <br />the lake side of the house, and a deck waIkway along the lef t side of the <br />house (see Exhibit F). <br />There is no question that the proposal will improve the appearance, <br />livability, and safety of the property. However, portions of the <br />proposed additions fall within the 0-75' setback area and will <br />increase the hardcover slightly in the 0-75' setback zone. I also do <br />not see a stai rway leading to the ground f rom the deck, and wonder if one <br />is planned. <br />Mr. Fegers and his builder have questioned the measurement of the <br />lakcshore setback as shown on the survey, noting that the water is at a <br />high level at this time. Indeed, by Code the lakeshore yard is <br />measured f rom elevat ion 929.4 MSI., whi ch in this case is located at some <br />i ndet ei mi nat e point in the marsh vegetation bord<?ring the open water . <br />In discussing this with the surveyor, he noted that it is not feasible <br />to determine a 929.4 contour in marshlands such as this because the <br />hummocks and mucky soil material ("loon poop" if you will excuse the <br />expression) <lo no yiel<l a st.ible, uniform bottom. If the water <br />elevation were at 929.4 right now, it might still be very taxing to <br />define the contour.
