Mr. Joy 'J ‘. rinocU>oi c: <br />Pago 3 <br />Mo roll 8, ]985 <br />2.Eugene Nelson and his relatives never hove formally resolved <br />the record lot status of this or the McCloud property. <br />3.Since half of I.ot 7 Morse Island Park Second Addition is <br />separated by a roadway frem your property, is not involved in <br />your purchase agreenicnt, and is owned by a separate party, <br />the City will agree to designating it as a separate <br />unbuildoble record lot. <br />4 .The original intent in defining record lots on Rig Island was <br />tc |)reservc the existing patterns of usage. The parcels <br />which you are purchasing, although owned by a mother, <br />daughter, and son, respectively, have beeen historically used <br />as a single property. <br />5.Section 10.33, Subdivision 6(A) of tlie Municipal Zoning Code <br />defines the "record lot" in the Seasonal Recreation District, <br />and spccifica11y requires that when centiguous or abutting <br />property (including properties separated by unimproved <br />riqhts-of-wa^^) are owned in common or become owned in common, <br />tjiey shall in total become a single record 3ot. A copy cf <br />this section is enclosed for your reference. <br />Therefore, although I may have indicated to you over the phone <br />last week that there might be som.e leeway in considering Lot C as <br />a separate record lot, there is no question that when Lot C and <br />Lots 6, 7, and 8 are all owned by you, they are considered as a <br />single record lot and may never be sold scrarately without City <br />Council approval under specified conditions (Section 10,31, <br />Subdivision 6(C)). <br />Presum.ing t)>e City approves the subdivision of the lakesliore <br />strip, your Record Lot 0 6 will include the scutliern portion of <br />the lakeshore strip and Lots 6, 7, and 8 and C of Morse Island <br />Park. In order to receive benefits of the autonatic lot area <br />variance granted per Section 10.31, Subdivision (6)(F), you will <br />have to acknowledge the record lot on a form provided by the City <br />and apply for a combination of all separate tax parcels per <br />Section 10.31, Subdivision 6(R). Vie will extend the deadline for <br />execution of these documionts to Septem.ber 3 5 , 1985. If you have <br />not returned them by that date, no automatic variance is granted <br />and you will have to make a formal variance application to the <br />Council (current foe is $150) in order to construct a new cabin <br />anywhere on the property. <br />By completing the automatic lot area variance forms, you maintain <br />your right to repair, expand, or replace the existing cabin. If <br />at some future date you wish to build a new cabin and retain the <br />old one as a guest house, a conditional use permit would bo <br />required.r <br />i
