(^1^- <br />i <br />t * <br />f <br />k <br />The pertinent question for this review is will these added uses <br />in the retail operation be considered an intensification of a non <br />conforming use. <br />Staff can report that we have had no problem with this operation. <br />The applicants have never violated a condition of their permit. At <br />various inspections of the site and upon personal visits to the store, <br />staff has never noted parking problems or a lack of suitable parking <br />area. <br />The current operation does not appear to be an intense use of the <br />physical plant. Both new uses will not result in expansion of the <br />retail area. As a result the parking needs and requirements remain <br />constant. There are no major permanent structural alterations invol <br />ved with the new uses. The changes deal only with the retail use - <br />elimininating or cutting down in one phase of retail and replacing it <br />with another retail use. The proposed new uses appear consistent with <br />the original intent and plan for the Summerfield Farms Market. <br />Staff Rec ndations <br />To recommend approval of the conditional use permit application <br />of Glenn Nellist and Lowell Schaper to permit a mini bake and delica <br />tessen operation at the Summerfield Farms Market at 3800 Wayzata Blvd. <br />based on the following findings: <br />1. The new uses will not involve permanent structural changes or <br />additions to existing structure. <br />2. The new uses will not involve expansion of the retail area. <br />3. The new uses will not encourage customers to consume food on <br />the premises as with a restaurant use. <br />4. The new uses appear consistent with the original intent and <br />scope of the market as set forth in Resolution 1646. <br />Appeal is subject to the following conditions: <br />1. All equipment installed to support the mini bake operation is <br />subject to the standards of the Uniform Building Code and Fire <br />Code. <br />2. The applicants must apply for a license from the Hennepin <br />County Community Health Department for the delicatessen use. <br />■i <br />i.' <br />Ail iVl t'- ■■
