Mabusth, Zoning Administrator <br />Date:February 15, 1985 <br />Subject: Discussion and Review of Proposed Amendment of Section 10.55, <br />Flood Plain and Wetlands Management, of the Zoning Code <br />I List of Exhibits <br />IF- <br />Exhibit A - Classification Sheet <br />Exhibit B - Model Ordinance <br />The City is required by State Law to adopt an ordinance to assure <br />wise development and use of the shorelands of certain protected waters <br />within the city that have been given a shoreland management classifi <br />cation . <br />These protected waters of the City have been classified by the <br />Commissioner of Natural Resources as follows: <br />Natural Environment Lakes <br />1. French Lake Marsh <br />2. Lydiard <br />3. Dickey <br />4. Classen <br />: .in <br />r <br />Recreational Development Lakes <br />1. Mooney <br />2. Tanager <br />3. Long <br />General Development Lakes <br />1. Minnetonka <br />2. Forest <br />General Development Streams <br />1. Long Lake Creek <br />Staff reviewed the classification data used to determine these <br />designations last year and concurred with the DNR findings. Review <br />Exhibit A, this list notes the various criterias used in the study. <br />The DNR has cstabli&ed a deadline of 1985 for all cities with <br />protected shoreland waters to update their ordinances providing the <br />standards and procedural implementation for their management. For our <br />City, it will involve the amendment of Section 10.55 of the Zoning <br />Code to include a shoreland overlay district that would govern future <br />development of the areas immediately surrounding the specified <br />protected waters. In the process of amending Section 10.55, staff <br />suggests a review of the existing wetlands and flood plain sections to <br />determine if there are omissions or a need to clarify or expand. <br />Staff recomends altering Section 10.55, Subdivision 8, Develop <br />ment Restricted; Prohibition, to delete the 26 feet setback from <br />flood plain elevation.
