The proposed deck extends into the 75' lakcshore setback <br />zone. The hardcover request is as follows: <br />Existing Hardcover <br />Proposed Hardcover <br />0-75' <br />0 sf or 0% <br />404 sf or 11 <br />75'-250* <br />1,175 sf or 13% <br />1,541 sf or 17% <br />Applicant was warned by staff that variances for new hardcover or <br />structures in the 0-75' zone are rarely granted, but ho wished to <br />proceed with the application regardless. Applicant notes that <br />placing the deek into the side yard wi 11 locate it direct.ly outside the <br />neighbors bedroom window, which wou 1 d not be very acceptable to either <br />party. <br />Both neighbors have indicated they have no objection to the proposal, <br />although the proposed deck with railings does extend past the average <br />setback line. There does not appear to be any hardc*over availal^le for <br />tradeoff in the 0-75' zone. Can you make ary findings that would <br />justify granting this variance?
