He requests a variance to the size <br />standard because he claims that at least two of his immediate <br />neighbors have boats over 20 feet in length stored in their <br />yards. (Note areas designated as 2 & 7 on staff survey - Exhibit <br />E.) In addition, he calls attention to the "numerous boats <br />stored on private p)roperty throughout the City of Orono". The <br />applicants consider staff’s actions highly discriminatory in <br />singling them out for actions deemed appropriate, natural and <br />completely acceptable on other neighbors’ lots and in other <br />neighborhoods throughout the City. <br />A second varianc<> to the exterior storage section is sought <br />by applicant claiming there is no other area on the property to <br />store the boat because of the sloping topography. The boat is <br />stored less than 35' from Pheasant Road and possibly less than <br />10’ from the side property line - survey does not confirm <br />setbacks. The ordinance allows a boat of less than 20 feet in <br />length stored in a rear yard 10 feet from any property line. <br />How does our code determine or define applicants’ rear yard? <br />The area between the lagoon and the house is the front/lakeshore <br />yard; the area between the house and Pheasant Road is the <br />street/side yard; the area between the house and street is the <br />front/street yard; the area between the house and east property <br />line is the side yard. The applicants' boat is stored in what <br />effectively is the extended front yard areas of the Pheasant Lawn <br />neighborhood along Pheasant Road. The boat is the first thing <br />observed as you enter the neighborhood and the last thing <br />observed as one exits. <br />1
