Zoning File #1470 <br />September 18r 1990 <br />Page 4 <br />No additional information was submitted by Parten. In <br />Summer 1990, he sold the property to the current applicant, who <br />has been working with ' caff to devise a PRD that addresses the <br />issues of concern. <br />The current applicant has acknowledged that a private road <br />will have to be constructed in Outlet C all the way to the loop. <br />Issues previously of concern but not addressed with the proposal <br />include : <br />A.Easement access for the City to Nature Conservancy <br />parcel. <br />B.Continuation of Outlet D for future use by Asao and <br />Deters properties. <br />C.Continuation of Outlet D for future access across Luce <br />Line Trail. <br />Regarding Item A, if the City requests an easement for <br />access to the nature conservancy parcel, that easement would <br />logically be through the neck area of Lot 1, Block 1. The <br />applicant could be requested to provide such an easement, which <br />would have no significant effect on the subdivision. The intent <br />of that easement would be merely for City maintenance of the <br />nature conservancy parcel should the City acquire it, and would <br />not be intended to provide public access to that parcel. <br />Regarding access to Asao and Deters, if an access corridor <br />was dedicated now, such corridor likely being within open space <br />Outlot B, the City would not have to deal with the homeowner's <br />association in the future should such an access become necessary. <br />Asao and Deters have stated they have no need for such an access. <br />Regarding the access to the north, such a concept met with <br />extreme resistance from property owners in the area, and if <br />proposed along the east property line would have a significant <br />effect on septic sites for Lot 1, Block 3 if such a road was ever <br />developed. Council might consider the option of making Outlot D <br />50* wide, and ending it at the south end of Lot 1, Block 3, with <br />the idea that should a future connection to the north become <br />necessary, there is adequate acreage in Outlot B and in the <br />Reiersgord property to accomodate that. <br />Staff RecoHBendation <br />Because Mr. Parten last appeared before the Council, this <br />application for preliminary plat is brought forth again to the <br />Council. The Planning Commission has not reviewed this specific <br />proposal. Council's options are as follows: <br />i <br />i
