Table application providing applicant additional time to <br />file a conditional use permit and variance application with <br />the City for the excavation of wetlands/floodplains within <br />the City of Orono; or <br />2. Approval finding the 6 lot proposal meets all standards of <br />the zoning code and subdivision regulations of the City. In <br />addition, there is adequate sewer and water capacity within <br />existing lines to serve the new development and that all <br />lots achieve access via an approved public roadway. <br />Approval is subject to the following conditions: <br />a) Payment of a park dedication fee based on 8% ci' the <br />fair market value to be determined by the City <br />Assessor upon final approval of the preliminary plat by <br />the Council of Orono. Payment to be made by applicant <br />upon filing of the final plat. <br />b) Granting of Flowage and Conservation Easement over <br />the wetlands defined below the 931.5' elevation. <br />Wetland to be defined as drainage easements on the <br />final plat. <br />c) Applicant to dedicate and designate all <br />drainageways on the plat as drainage easements at a <br />minimum width of 15*. <br />d) Applicant to be responsible for expansion of <br />municipal sewer service and upgrading of Old Beach Road <br />consisting of leveling and 2” bituminous overlay <br />e) The City of Orono shall agree to the creation of <br />Outlot A for the exclusive ownership of either the <br />Fresh Water Institute or Foundation. Such usage to be <br />limited by special covenants to be approved by the <br />City. Such covenants shall not be in conflict with the <br />ordinance of the City that protect wetland floodplain <br />areas as set forth in Section 10.55 of the municipal <br />code. <br />f) Final plat to show a 25' wide drainage and utility <br />easement along the street lot lines of Lots 6 and 7 <br />through Lot 8 up to the utility easement over the <br />City's lift station. Final plat should designate <br />existing utility easement over lift station. <br />g) Applicant to provide amended sanitary sewer <br />extension plans for final approval by the City. <br />h) Applicant is advised that the current sewer unit <br />charge for new construction for the year of 1990 is <br />$897.62. This will be adjusted each year based on the <br />inflationary rate.
