Zoning File #1555 • <br />July 12, 1990 <br />Page 3 of 5 <br />SEWER & WATER UTILITIES - <br />Already noted in the sketch plan review, there will be a <br />sewer unit charge of $897.62 for each sewer unit based on the <br />1990 fee schedule. This fee is adjusted each year based on an <br />inflationary rate. There will be no water unit charges for the 6 <br />lots within Orono. Minnetonka Beach shall be charged at the same <br />sewer unit rate quoted for Orono. There will be a charge of <br />$1,691.78 per water unit for lots within the Minnetonka Beach <br />area. There is an existing water main within Old Beach Road. <br />The applicant proposes a 500' extension to the north to serve the <br />northern lots within Minnetonka Beach. The City of Minnetonka <br />Beach shall be responsible for portions of the water lines within <br />the boundaries of their City. This may also be an issue to <br />discuss at a future date with the administrator of Minnetonka <br />Beach. <br />Please review Exhibit F, staff must ask that the proposed 8" <br />sanitary sewer line be amended as shown on the staff sketch <br />(Exhibit F). The City does not approve of public utility lines <br />placed within the private boundaries of properties because of the <br />difficulties of achieving access and creating an impact upon <br />existing improvements within those lots. The City staff <br />recommends that the sewer line be routed down Old Beach Road and <br />then along County Road 19 up to the lift station. The City will <br />ask for a 25' wide drainage and utility easement along the street <br />lot lines of Lots 6 and 7 up to the lift station in Lot 8. <br />Applicant's surveyor should designate existing utility easement <br />over lift station within Lot 8. <br />DRAINAGE/GRADING PLAN - <br />At the time of the sketch plan review. City staff had asked <br />that the revised grading plans show locations where fill had <br />previously been placed as part of the dredging project within the <br />Lafayette Bay area in 1978. The filling involved Lots 4, 5, 6, 7 <br />and 8 within the City of Orono. Note that the wetlands has been <br />defined at the 931.5' elevation. The major concern for this <br />review is that the City of Orono is asked to approve excavations <br />within the defined wetland area to offset filling of the flood <br />plain/wetlands/lakeshore protected area of Lot 1, Block 2 within <br />the City of Minnetonka Beach. Applicant failed to advise the <br />City of this land alteration at the time of the sketch plan <br />review. If the City had been advised of the proposed land <br />alterations, a separate conditional use permit and variance <br />application would have been required to be filed within the <br />preliminary subdivision application. Section 10.55, Subdivision <br />8 prohibits the filling of floodplains, wetlands and lakeshore <br />protected areas within the City. If an applicant wishes to fill <br />within these protected areas, a variance application is required <br />and a statement of hardship must accompany that application.
