MINUTES OF APRIL 16, 1990 PLANNING COMMISSION MEETING <br />ZONING FILE #1516-MACMILLAN CONTINUED <br />building permit for MacMillans' new residence <br />Baldwin asked if it would be possible to overlap that <br />schedule to allow construction to begin while the estate of the <br />applicant's mother is being settled. <br />Tay]or stated that it he cannot be certain that the existing <br />house will be torn down. He said that the lot line may have to <br />be realigned to preserve the house and the tennis court. <br />Cohen said that Mr. Taylor's statement put new light on the <br />information presented this evening. <br />Mr. MacMillan explained that there are other heirs involved <br />and the decision to remove the house is not solely his to make. <br />Bellows suggested tabling this application because the <br />information presented at this point is incorrect. Bellows said <br />that the Planning Commission would probably be amenable to <br />recommending an extension of time to remove the principal <br />structure. <br />Johnson preferred to see the house removed prior to the <br />issuance of a building permit. He indicated that such a <br />requirement is a consistent policy of the City and there should <br />be no exception. <br />There were no comments from the public regarding this matter <br />and the public hearing was continued. <br />It was moved by Planning Commissioner Cohen, seconded by <br />Planning Commissioner Hanson, to table this application. Motion, <br />Ayes-6, Nays-0, Motion passed. <br />#1517 WHITNEY MACMILLAN <br />1560 FOX STREET <br />CONDITIONAL USE PERMIT <br />PUBLIC HEARING 8:07 P.M. TO 8:09 P.M. <br />The Affidavit of Publication and Certificate of Mailing were <br />duly noted. <br />Gaffron reviewed the information pertaining <br />MacMillans' application to enlarge an existing pond. <br />the <br />There were no comments from the public regarding this matter <br />and the public hearing was closed. <br />It was moved by Planning Commissioner Cohen, seconded by <br />Planning Commissioner Bellows, to recommend approval of the <br />conditional use permit for reconstruction of an existing <br />artificial pond, subject to staff's conditions 1 through 6. <br />- 6 -
