Zoning File #1516 <br />May 16,.. 1990 <br />Page 2 of 3 <br />The applicants have verified the location of the tennis <br />court in Lot 1, Block 1 to be 19.6' from the lot line at the <br />northeast corner and 21.5' at the northwest corner. Will <br />Planning Commission accept the existing setback given that this <br />is an existing tennis court rather than a new structure? Now <br />that the lot will contain a principal structure, there is no <br />specific requirement tha*- the tennis court be removed. (Mrs. <br />MacMillan indicates they - *emove the rennic court rather than <br />revise the lot line.) <br />It appears that all Issues addressed at the last meeting <br />have been resolved. <br />Staff Reconmendation - <br />Following is a list of recommended approval conditions based <br />on Planning Commission's previous discussion and the current <br />revisions: <br />1. Approval of lot lines and outlot configurations and <br />locations as shown on the revised preliminary plat dated May <br />3, 1990. <br />2. No upgrading of the existing private roadways within <br />Outlot C will be required nor will construction of the cul- <br />de-sac be required, until such time that Outlot B is <br />approved by the City Council for development. <br />3. Lot 1, Block 1 shall continue to use the existing <br />westerly driveway access to Fox Street. <br />4. Standard format road and utility easement shall be <br />granted to the City over Outlot C. <br />5. Applicants shall execute the standard covenant for <br />maintenance of this private roadway. <br />6. Planning Commission strongly recommends that a <br />homeowners' association of property owners using the roadway <br />be formed. <br />7. Standard drainage and utility easements along all <br />property lines shall be granted. <br />8. Outlets A and B are designated for future development, <br />requiring that access, lot standards, and septic testing all <br />be found acceptable bv this or a future City Council before <br />any development may'occur on these 2 outlets (Flowage 6 <br />Conservation easements will not be required over the ponds <br />or wetlands in these outlets until future development <br />occurs). <br />li <br />.]
